Explainer: Older brother got NT$5 million from their father 10 years ago, but younger brother can still claim a larger inheritance! 3 types of gifts to watch for
Published ・ Source Taiwan | 風傳媒
This article explains the Civil Code’s gift equalization system, under which property parents gave their children during their lifetime for marriage, separation or business purposes must still be included in the estate after their death to ensure fairness. It also distinguishes this system from the inheritance tax rule covering gifts made within 2 years of death.
Facts
Under Article 1173 of the Civil Code, if an heir received property from the deceased before inheritance commenced for marriage, separation or business purposes, the value of the gift must be added to the property left by the deceased at the time of death to calculate the estate, and deducted from the recipient heir’s share.
In a hypothetical scenario, a father leaves an estate of NT$10 million, and the older brother previously received NT$5 million in business funding. After the gift is accounted for, the older brother receives NT$2.5 million from the estate, while the younger brother receives NT$7.5 million.
The gift is valued at the time it was made; its amount is not automatically adjusted for changes in prices over the years.
Under Article 15 of the Estate and Gift Tax Act, property given by the deceased to an heir within 2 years before death is generally treated as part of the estate and taxed accordingly. This is a different legal system from gift equalization under the Civil Code.
A 2012 Ministry of Justice interpretation states that if the value of an heir’s gift exceeds their share of the estate, they may not participate in the distribution of the remaining estate. However, under the Supreme Court’s interpretation, they do not have to return the excess.

Will Democrats halt U.S. AI development? Analysts give 2 reasons not to worry: They can’t accept this either
Published ・ Source Taiwan | 風傳媒
The Democrats’ sweeping victory in the U.S. midterm elections sparked market concerns about tighter AI regulation and sent Taiwan stocks tumbling. Analysts say the long-term development of AI is irreversible because of the need to guard against competition from China and the president’s veto power. They advise investors to watch semiconductor indexes, exchange rates and margin financing changes to gauge when the market may bottom out.
Facts
The Democrats swept the U.S. midterm elections, and Taiwan stocks fell 1,374 points, or 3.2%, to close at 41,574 today (the 5th).
Securities analysts Lai Youyu and Weng Xiangwei said on the program 《元大看盤室》 that the main reason for Taiwan stocks’ sharp correction was a negative reaction to the Democrats’ victory and the prospect of a brake on AI expansion.
Weng Xiangwei said a slowdown in AI capital spending does not mean development will stop, as a complete halt would risk China overtaking the United States, and President Trump has veto power.
The pace and scale of the current reduction in margin financing are still insufficient. Investors should continue to watch whether margin financing can fall by more than NT$15 billion, which would be a positive signal that the market is stabilizing.
Although Taiwan stocks’ monthly moving-average deviation has reached 10.86%, meeting the conditions for a technical rebound, margin financing remains the key factor.

Democrats propose “super AI ban” with nuclear-weapons-level penalties; violations could bring 20 years in prison or corporate death penalty.
Published ・ Source Taiwan | 鉅亨網
U.S. Democrats are advancing the Artificial Superintelligence Prohibition Act of 2026, which would ban ASI research and establish an AI agency for oversight. Violators could face up to 20 years in prison or the corporate death penalty, in an effort to prevent the technology from spiraling out of control.
Facts
The Artificial Superintelligence Prohibition Act of 2026 has drawn renewed attention after Democrats gained control of both chambers of Congress following the U.S. midterm elections.
The bill was introduced by independent Senator Sanders and Democratic Representative Casar, and calls for a comprehensive ban on ASI research and deployment.
The bill defines ASI as an AI system that surpasses human cognitive performance in most fields or has the ability to overthrow the U.S. government.
Companies in violation would face a “corporate death penalty,” including having their operating licenses revoked, being forcibly dissolved and having their assets confiscated.
Individuals responsible for violations could face up to 20 years in federal prison, with sentencing standards comparable to serious national security offenses involving the illegal development of nuclear weapons.
Advanced AI systems with computing power of at least 10 to the 25th power operations would be subject to a mandatory research pause until a regulatory framework is established.
Musk responded, “What a brave new world,” mocking political intervention in technological development.

Nationwide general strike begins! French 2027 budget rejected by parliament; expert says this gives government time to turn to forced measures.
Published ・ Source Taiwan | 鉅亨網
France's National Assembly rejected the 2027 budget bill, as no party holds a majority and consensus proved elusive. The government is expected to invoke its constitutional powers to force the bill through, while facing a nationwide general strike and social unrest, adding to mounting fiscal and political pressure.
Facts
France's National Assembly unanimously rejected the 2027 budget bill proposed by Prime Minister Lecornu's government on Wednesday (4).
The 2027 budget bill's central measure is to cut spending by 54 billion euros (about 61.8 billion dollars).
France's fiscal deficit reached 5.1% of GDP last year, while public debt rose to 115.6% of GDP.
Since student protests over education funding cuts began in September, demonstrations have spread nationwide and escalated into unrest, causing estimated economic losses of more than 1 billion euros.
A nationwide general strike began on Thursday (5), with hundreds of thousands taking to the streets; police in Lyon fired tear gas.
The government deployed 70,000 police officers and gendarmes to respond to the nationwide general strike and unrest.
The Eurasia Group said the vote had little practical significance and that the rejection instead gave the government time to turn to forced measures.
