Published ・ Source Taiwan | 風傳媒
The article explains Taiwan's estate tax rule requiring gifts made within 2 years before death to be included in the estate. It notes that even if the stocks have been sold, their market value on the date of death is still included in the estate. It also mentions that a new law takes effect in 2026, under which the tax burden will instead be shared proportionally by the recipients.
Facts
Property gifted to certain relatives within 2 years before the decedent's death is treated as part of the estate at the time of death and included in the total estate for tax purposes.
The estate value of stocks gifted within 2 years before death is based on their market value on the date of the decedent's death.
Amendments to the Estate and Gift Tax Act, effective September 13, 2026, stipulate that recipients will bear a proportional share of the tax on property gifted to certain relatives within 2 years before death and included in the estate.
The annual gift tax exemption is NT$2.44 million in both 2025 and 2026.
If gifted property has been transferred or lost, the recipient must meet the corresponding tax payment obligation based on its market value at the time of the decedent's death.

The Cieding Gong 14 site is close to the coast and wetlands and faces environmental challenges including high salinity, strong winds, salt spray, drought, seasonal flooding and compacted soil.
The Kaohsiung Tree Planting Association said its afforestation effort has shifted from focusing on “how many trees to plant” to considering “what kind of ecological habitat to create.”
This restoration approach aligns with the internationally recognized concept of “nature positive,” which emphasizes actively restoring ecosystem functions.
